Registration Guidance for Marriage between Chongqing

Permanent Residents and Foreigners, Hong Kong, Macau and

Taiwan Residents and Overseas Chinese

I.       Registration authority

Chongqing Marriage & Adoption Registration Administration Center

II.      Responsibilities

(I)      Undertake specific registration of marriage and adoption involving foreigners, Hong Kong, Macau and Taiwan residents, and overseas Chinese;

(II)     Provide guidance for marriage and adoption registration administration throughout Chongqing;

(III)   Propagandize the marriage and adoption policies and provide marriage and family consultation service.

IV.     Prerequisites for Marriage Registration

(I)      One party is a permanent Chongqing resident while the other party is a Hong Kong, Macao or Taiwan resident, an overseas Chinese or a foreigner;

(II)     Parties who wish to contract a marriage must be of legal age for marriage, which is 22 years for males and 20 years for females;

(III)   Both parties must have no spouse;

(IV)   Marriage must be based upon the complete willingness of both parties, who shall get marriage registered in person at the marriage registration authority. The marriage contracted in the name of others or conducted by either party to the marriage is not permitted;

(V)     All the credentials and certification documents provided by the parties concerned must be true, legal, complete and authentic;

(VI)   Both parties shall not be lineal relatives by blood, or collateral relatives by blood up to the third degree of kinship;

(VII)  Both parties are not suffering from any disease which is regarded by medical science as rending a person unfit for marriage.

V.      Credentials and Certification Documents to be Submitted for Marriage Registration

(I)      For Chongqing Permanent Residents:

A valid identity card and household register of the party concerned

If the party concerned was previously married, the relevant documents should be provided to certify the dissolution of marriage, such as the divorce certificate, certificate of effective court decisions, and death certificate of spouse.

(II)     For Hong Kong Residents:

1.    A Mainland Travel Permit or Home Return Permit for Hong Kong and Macau Residents;

2.    A Hong Kong Identity Card;

3.    A declaration stating that the party concerned has no spouse and is neither the lineal relative by blood nor the collateral relative by blood up to the third degree of kinship of the other party, which shall be notarized by the notary public authorized in Hong Kong.

(III)   For Macau Residents

1.    A Mainland Travel Permit or Home Return Permit for Hong Kong and Macau Residents;

2.    A Macao SAR Resident Identity Card;

3.    A declaration stating that the party concerned has no spouse and is neither the lineal relative by blood nor the collateral relative by blood up to the third degree of kinship of the other party, which shall be notarized by the notarization authority in Macau.

(IV)   For Taiwan Residents

1.    A Mainland Travel Permit for Taiwan Residents or other valid travel documents;

2.    A valid identity card of the party concerned as living in Taiwan;

3.    A declaration stating that the party concerned has no spouse and is neither the lineal relative by blood nor the collateral relative by blood up to the third degree of kinship of the other party, which shall be notarized by the notarization authority in Taiwan.

(V)     For Overseas Chinese:

1.    A valid passport of the party concerned;

2.    A Certification certifying that the party concerned has no spouse and is neither the lineal relative by blood nor the collateral relative by blood up to the third degree of kinship of the other party issued by the notarization authority or competent authority in the country of residence and certified by the Embassy (Consulate) of the People's Republic of China in that country, or a certification certifying that the party concerned has no spouse and is neither the lineal relative by blood nor the collateral relative by blood up to the third degree of kinship of the other party issued by the Embassy (Consulate) of the People's Republic of China in that country.

(VI)   For Foreigners:

1.    A valid passport or other valid international travel documents of the party concerned;

2.    A Certification certifying that the party concerned has no spouse issued by the notarization authority or competent authority in the country of residence and certified by the Chinese Embassy (Consulate) in that country or the Embassy (Consulate) of that country in China, or a certification certifying that the party concerned has no spouse issued by the Embassy (Consulate) of that country in China.

(VII)  Photo

Please take three 2-inch recent group photos that are bareheaded and half-length in red or blue background for registration

VI.    Friendly Tips:

(I)      Authenticity of information

1.    All the required credentials must be originals.

2.    In case the marital status declared by the party concerned is inconsistent with that recorded in the marriage registration files, the party concerned should provide the registration authority with the effective judicial documents of the court, the resident’s medical certificate of death for the spouse and other information certifying the authenticity of declaration.

3.    The party who is not granted for divorce registration by concealing true situations, providing false document, making false statement and in the name of others or represented by either party to the marriage will cause serious legal consequence and undertake corresponding legal responsibilities.

(II)     Marriage registration appointment

You’re required to make an appointment online through the following ways for the registration of marriage with foreigners, Hong Kong, Macau and Taiwan residents, and overseas Chinese.

(III)   Requirements for household register

1.    Chongqing permanent resident should provide the complete Household Register, and seals on each sheet must be complete and correct. If the seals are not complete or correct, please first complete and correct them at the Public Security Bureau having jurisdiction over his/her household registration before conducting the marriage registration.

2.    Chongqing collective household resident should conduct the marriage registration by presenting his/her household registration sheet in the Collective Household Register or the copy of Household Register bearing seal of the authority recording his/her household registration information.

3.    The details on the Identity Card and Household Register, such as name, sex, date of birth and ID Card No., must be identical. If not, the parties concerned should correct them at the competent authority.

4.    The marital status recorded in the Household Register or that in the declaration should be consistent. If not, the party concerned should provide the registration authority with the effective judicial documents of the court, the resident’s medical certificate of death for the spouse and other information certifying the authenticity of declaration; in case the information is inconsistent and relevant information is not available, the party concerned should correct them at the competent authority.

(IV)   Requirements for single status affidavit

1.    The correct and valid Single Status Affidavit should clearly specify such words as 'unmarried', 'single', 'divorced' and 'widowed', indicating that the party concerned has no spouse now. The Divorce Certificate, Death Certificate of Former Spouse or Certification certifying that the party has no marriage registration record or no impediment to marriage in a district and within a period cannot be used for conducting marriage registration instead of the Single Status Affidavit.

2.    When the Single Status Affidavit and other information provided by the party concerned to the marriage registration authority are in foreign languages, they must be translated into Chinese. It should be deemed as not providing the document if the party concerned can’t provide a corresponding Chinese translation. The marriage registration authority may accept the translation version issued by the Chinese Embassy or Consulate in the foreign country or eligible translation agency.

3.    The Single Status Affidavit or Certification of the party concerned should be valid for 6 months from the issuing date.

(V)     Requirements for entry documents

1.    The Passport or Permit must be true, legal and valid, otherwise the party concerned should be regarded as illegal entry or illegal present and marriage registration for them will not be granted.

2.    The party concerned who has multiple nationalities should only conduct the marriage registration following the procedures and requirements for one of the identities through legal entry.

(VI)   Re-issuance of marriage registration documents

1.    In case the marriage certificate is lost or damaged, the party concerned may apply to the former authority conducting the marriage registration or the marriage registration authority of the place where one of the parties registers his/her household for re-issuance.

2.    In case the party concerned has conducted the marriage registration but his/her marital status was changed due to divorce or widowing when applying for the re-issuance, the marriage certificate will not be reissued.

4.    In case the party is unable to apply for a reissued marriage registration certificate at the marriage registry due to some reasons, and there are archives available for consultation, which are consistent with the identity information of the party, the party may authorize others to handle the registration. The authorized person shall submit the party’s household register, ID card and a power of attorney certified by a notary. The power of attorney shall clearly state the party’s name, ID number, the time for marriage registration, the name of the registry, current marital status, the matter concerned, and the name and ID number of the authorized person. The authorized person shall submit his/her own identity document together with the above-mention materials.
